HC scraps Delhi govt’s order appointing 21 parliamentary secretaries


Arvind KejriwalThe Delhi High Court on September 8 struck down the controversial decision of the Delhi government to appoint 21 AAP legislators as parliamentary secretaries. The court ruled that the said decision was not cleared by Lieutenant Governor Najeeb Jung.

A two-member bench of Chief Justice G Rohini and Justice Sangita Dhingra Sehgal passed the order after the AAP counsel said that March 13, 2015 decision was taken without the approval of the L-G.

Senior advocate Sudhir Nandrajog, who appeared for ruling Aam Aadmi Party, referred to the court’s August 4 judgement wherein it had rejected several notifications issued by the government stating that they were issued without the L-G’s clearance.

During the brief hearing, the Ministry of Home Affairs (MHA) had told the court that such an appointment was “not covered by the law.”

If the Election Commission were to decide that the appointments were illegal, the MLAs may also face disqualification.
